These terms are an agreement between you and Parsync LLC ("we", "us"), the operator of FlipTide. By connecting FlipTide to an AI app or to your eBay store, you agree to them. If you do not agree, do not use FlipTide.
What FlipTide does
FlipTide connects your eBay store to AI assistants such as Claude and ChatGPT. It sorts your item photos, drafts listings, and creates, publishes, changes or ends eBay listings when you tell it to. FlipTide is an independent product. It is not made, endorsed or supported by eBay, Anthropic or OpenAI.
Who can use it
- You must be at least 18 and able to enter a binding contract.
- You need your own eBay seller account, and you must follow eBay's User Agreement and selling policies.
- If you use FlipTide for a business, you accept these terms for that business.
Your account
Keep your sign-in details and any FlipTide connection keys private. You are responsible for what happens through your account, including anything an AI app does with FlipTide on your behalf. Tell us right away at support@fliptide.io if you think someone else has access.
Your listings are your responsibility
- FlipTide uses AI to suggest titles, descriptions, categories, conditions and item details. AI can be wrong. Review every draft before you publish it.
- FlipTide publishes or ends a listing only when you confirm it. Once you confirm, the listing, its price and the item it describes are yours to stand behind with buyers and with eBay.
- You must have the right to sell each item and to use each photo you upload. Do not list items eBay prohibits or restricts.
- eBay fees, sales, shipping, returns and buyer disputes are between you, your buyers and eBay. FlipTide is not part of those transactions.
Pricing and payment
- Prices are listed on our pricing page. A new store gets 3 free listings.
- A listing is used the first time FlipTide drafts an item. Sorting photos, editing drafts, publishing and ending listings do not use a listing.
- Listing packs are one-time payments, and pack listings do not expire. If we offer monthly plans, their allowance resets each billing period and does not roll over.
- Payments are processed by Stripe under Stripe's terms. You authorize us to charge the payment method you provide for the pack or plan you choose.
- If you think a charge is wrong, email us within 30 days and we will review it.
We may change prices for future purchases. Changes do not affect listings you have already bought.
Acceptable use
Do not:
- use FlipTide to break the law or eBay's rules, or to list counterfeit, stolen or prohibited goods;
- upload content you do not have the right to use, or content that is unlawful or harmful;
- try to get around listing limits, free-listing rules, security or access controls;
- overload, probe, scrape or reverse engineer FlipTide, or resell access to it;
- use FlipTide to access an eBay store you are not authorized to manage.
Your content
You own your photos, listings and other content. You give us permission to store, process and send that content to eBay and our service providers, only as needed to run FlipTide for you. Our privacy policy explains how we handle your data.
Our service
FlipTide, including its software, design and name, belongs to Parsync LLC. We give you a personal, non-transferable right to use FlipTide under these terms. We may change, add or remove features. FlipTide depends on eBay, AI providers and other third parties. If they change or stop their services, parts of FlipTide may stop working.
Ending your use
You can stop using FlipTide at any time. Remove its access in your eBay account settings, and email us if you want your data deleted. We may suspend or end your access if you break these terms, if eBay or the law requires it, or to protect FlipTide or other users. Listings you already published stay on eBay until you end them.
Disclaimers
FlipTide is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not promise that FlipTide will be uninterrupted or error-free, that AI drafts will be accurate, or that any listing will sell.
Limits on liability
To the extent the law allows, we are not liable for lost sales, lost profits, lost data, or indirect, incidental, special or consequential damages. Our total liability for any claim about FlipTide is limited to the greater of the amount you paid us in the 12 months before the claim and $100. Some places do not allow these limits, so they may not fully apply to you.
Indemnity
If a claim is brought against us because of your listings, your content or your breach of these terms, you agree to cover our reasonable costs and losses from that claim.
Changes to these terms
We may update these terms. We will change the date at the top, and if a change is significant, tell you in FlipTide or by email before it takes effect. If you keep using FlipTide after a change takes effect, the new terms apply.
Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules.
